Terms and Conditions
The terms and conditions below apply to all coaching provided by Krishnathelifecoach LLC ("the Coach") to any individual or organization ("the Client") and constitute the Agreement for the service to be provided by the Coach for the Client. The term 'life coaching' covers all areas of life for the Client, in having the desire to improve or attain a more fulfilling life moving forward.

In return for the fees payable by the Client (or by a third party on their behalf), the Coach agrees to provide the service as described below and follows the terms and conditions set out below and the coaching agreement. The Client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the costs, the third party counts as an agent acting on behalf of the Client).
The date the first paid coaching session takes place shall be deemed the start date for the service. Participation by any individual in the first paid coaching session constitutes acceptance of these terms and conditions.

1) Client-Coach Relationship
Coach agrees to maintain the ethics and standards of behavior established by the Association for Coaching (AC) global codes of ethics. Therefore, it is recommended that the Client review the AC Code of Ethics and the applicable standards of behavior: https://www.associationforcoaching.com/page/AboutCodeEthics.
The Client is solely responsible for creating and implementing their physical, mental, and emotional well-being, decisions, choices, actions, and results arising from or from the coaching relationship and coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions, inaction, or any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy, does not substitute for treatment if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
Client further acknowledges that they may terminate or discontinue the coaching relationship at any time with written notice of a minimum of three (3) business days.

The Client acknowledges that coaching is a comprehensive process involving different areas of their life, including professional, spiritual, financial, health, relationships, education, recreation, etc. The Client agrees that deciding how to handle these issues, incorporating coaching principles into those areas, and implementing choices is exclusively the Client's responsibility.
The Client acknowledges that coaching does not involve diagnosing or treating mental disorders as defined by the United States or the American Psychiatric Association. That coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical, or other qualified professionals and that it is the Client's exclusive responsibility to seek such independent professional guidance as needed. Suppose the Client is currently under the care of a mental health professional. In that case, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and Coach.

The Client understands that to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback, assistance, and guidance, and create the time and energy to participate fully in the program.

2) Services
Coaching services will be offered within the individual sessions or package deal. A coach will be available to the Client through scheduled sessions. In addition, a client may contact a coach in between sessions via email related to the coaching agreement.

Package Deal: The deal is tailored to the Client's needs on a 1- or 3-month coaching agreement.

3) Schedule and Fees
This Coaching Agreement is valid for the selected coaching session/package (amount of sessions and the time allocated per session), agreed upon by the Client and Coach. The fee must be submitted before the session.

Should you need to reschedule a coaching session, you may provide 24-hour notice in advance of your session and make up the session within a week of the originally scheduled date. Sessions not canceled 24 hours in advance will not be eligible for make-ups. You must prioritize this coaching relationship to receive the full benefit of your coaching session.

4) Procedure
Client and Coach will determine the time of the coaching sessions based on a mutually agreed upon time and online platforms, such as ZOOM or Google meetings (recorded meetings for Client reference and Coach file).
5) Confidentiality
This coaching relationship, as well as all Information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality outlined in the AC Code of Ethics. However, please be aware that the Client and Coach relationship is not considered a legally confidential relationship (like the medical and legal professions). Thus communications are not subject to the protection of any legally recognized privilege. Accordingly, the Coach agrees not to disclose any information on the Client without the Client's written consent. In addition, the Coach will not tell the Client's name as a reference without the Client's consent.

Confidential Information does not include Information that: (a) was in the Coach's possession before the Client furnished it; (b) is generally known to the public or in the Client's industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without the use of or reference to the Client's Confidential Information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges their continuing obligation to raise confidentiality questions or concerns with the Coach on time.

6) Release of Information
The Coach engages in training and continuing education, pursuing and maintaining Association for Coaching Council Credentials. That process requires the names and contact information of all Clients for verification by AC Council. By signing this Agreement, you agree to have only your name, contact information, and start and end dates of coaching shared with AC Council staff members. Other than parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared.

According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and coaching professional development and/or consultation purposes.

7) Refund & Cancellation Policy
All agreements are binding. I do not offer refunds on coaching services. I am here to coach you to your highest level of success, and part of that requires a commitment from you that you are fully invested in your coaching. When refunds are an option, the Client can have "one foot in" the work and "one foot out" the door. Therefore, it is to your benefit to decide before purchasing a session/package deal and committing to working with me that I am the right Coach for you. You need to be 100% in if you are in, just as I will be for you.

"Package Deal" Purchase: This is under rare occasions, the Client-Coach relationship may not be a match, and it may be best for both parties to go their separate ways. The coach will refund the Client the remaining balance of sessions.

Intuitive Tarot/Oracle Session: No refund if not canceled 24 hours before the session.

8) Record Retention Policy
The Client acknowledges that the Coach has disclosed his/her record retention policy concerning documents, Information, and data acquired or shared during the term of the Coach-Client relationship. Accordingly, Suche Coach will maintain such records in a format of the Coach's choice (print or digital/electronic) for less than two (2) years.
9) Termination
Either the Client or the Coach may terminate this Agreement at any time with written notice of a minimum of three (3) business days.

10) Responsibilities
The Coach will seek to enable the Client to improve his/her self-esteem and quality of life and to achieve the desired outcome(s). Remarkable results can be achieved where Clients follow a clear plan in a committed way. However, the Client has sole responsibility for making important decisions in their life. The Coach has no liability for any loss incurred by any Client, whether financial or otherwise, following the commencement of coaching sessions or for any perceived failure by the Client, whether justified or otherwise, to achieve a material improvement in quality of esteem, life, professional or to achieve their desired outcomes or goals.

11) Variation of Terms and Conditions
Where an Initial Number of Sessions is agreed upon, any changes to these terms and conditions intended to take effect before the conclusion of those Initial Number of Sessions will only have effect if agreed by both the Coach and the Client and confirmed by the Coach in writing by email. In other cases, the Coach may change any of these terms or conditions, including the Per Session Fee, by giving the Client two weeks' written notice by email of the change(s). If following receipt of such notification of the change, the Client no longer wishes to proceed with further coaching sessions, the Client may withdraw from the service immediately by giving notice in writing by email. The Coach will determine if the Client is entitled to a refund and, if so, how much. Such notice will be effective on receipt by the Coach.

12) Governing Law
The Coaching Agreement is governed by the Law of the U.S. Virgin Islands, whose courts have exclusive jurisdiction over any dispute, disagreement, proceedings, or legal claim of any nature relating to the service provided or the Agreement.

13) Disclaimer
By participating in/reading my coaching service/website/blog/email series, you acknowledge that I am not a licensed healthcare professional and my services do not replace the care of psychologists or other healthcare professionals. Coaching is in no way to be construed or substituted as psychological counseling or any other type of therapy or medical advice. I will always exercise my best professional efforts, skills, and care. However, I cannot guarantee the outcome of coaching efforts and/or recommendations on my website/blog/email series, and my comments about the outcome are expressions of opinion only. I cannot make any guarantees other than to deliver the coaching services purchased as described.
